The English version of these Terms of Service is the controlling version. The Japanese version below is provided for reference and convenience only. If there is any inconsistency or conflict between the English version and the Japanese translation, the English version shall prevail, except where prohibited by applicable law.

OVERVIEW

Welcome to Hand Drip Audio, Japan. Throughout these Terms of Service, the terms “we,” “us,” “our,” and “the Store” refer to Hand Drip Audio, Japan, operated by CREATION FLOW.

We operate this website and online store, including all related information, content, products, features, tools, and services, to provide you with a curated shopping experience (collectively, the “Services”). Our store is powered by Shopify, which enables us to offer the Services to you.

By accessing, browsing, or using our Services, or by purchasing any product from us, you agree to be bound by these Terms of Service, our Return & Refund Policy, Privacy Policy, and other policies referenced on this website. If you do not agree to these Terms, you must not use our Services.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory warranty, right of withdrawal, cooling-off right, or other right or remedy that cannot be excluded, restricted, or modified under applicable law.

SECTION 1 - ELIGIBILITY, ACCESS, AND ACCOUNT

By using our Services, you represent that you are at least the age of majority in your place of residence, or that you are using the Services under the supervision and consent of a parent or legal guardian.

We make reasonable efforts to display our products as accurately as possible. However, actual product colors, textures, packaging, appearance, accessories, or specifications may differ depending on your display device, monitor settings, lighting, manufacturing lots, manufacturer updates, or changes made by manufacturers or distributors.

All product descriptions, specifications, compatibility information, packaging details, images, weights, dimensions, included accessories, manufacturer warranty information, and availability are subject to change without notice.

Some product information may be based on information provided by manufacturers, distributors, or other third parties. While we make reasonable efforts to keep such information accurate and up to date, we do not independently verify every specification, compatibility statement, image, package detail, accessory list, or warranty description provided by manufacturers or other third parties.

To the fullest extent permitted by law, we are not responsible for errors, omissions, specification changes, design changes, packaging changes, accessory changes, compatibility differences, warranty description errors, or other inaccuracies caused by manufacturers, distributors, or other third-party information providers.

If we discover a material error or change before shipment, we may contact you to confirm whether you wish to proceed with the order, modify the order, or cancel the order. If the product has already been delivered and materially differs from the order or product description, we will handle the matter in accordance with our Return & Refund Policy and applicable law.

We reserve the right to limit the sale of products to any person, region, or jurisdiction, and to limit quantities on a case-by-case basis.

SECTION 3 - ORDERS AND ACCEPTANCE

Placing an order on our website constitutes an offer to purchase the products in your cart. After you place an order, you will receive an order confirmation email acknowledging receipt of your order. This confirmation does not mean that your order has been accepted.

Your order is deemed accepted only when we confirm shipment or otherwise expressly accept the order after payment or payment authorization has been successfully completed.

We reserve the right to refuse, cancel, or limit any order at our sole discretion, including in cases involving:

suspected fraud or unauthorized transactions;
inaccurate pricing or product information;
product unavailability;
shipping restrictions;
import or export restrictions;
violation of these Terms.

If we need to cancel or materially change your order, we will attempt to notify you using the contact information you provided.

Please review your order carefully before submission. Once an order has entered “preparing for shipment” status or later, cancellations, changes, and returns due to customer convenience are not accepted, except as expressly provided in our Return & Refund Policy or required by applicable law.

You represent and warrant that purchases made through the Store are for lawful personal use and not for resale, redistribution, or export in violation of applicable laws.

SECTION 4 - PRICES, CURRENCY, TAXES, AND BILLING

All prices are listed on a per-product basis.

Unless otherwise stated, product prices are shown inclusive of Japanese consumption tax. Shipping charges and any customs duties, import taxes, VAT, clearance fees, brokerage fees, or other charges imposed by the destination country, authorities, carriers, or payment providers are not included in the product price.

Shipping fees will be shown at checkout or otherwise indicated before completion of your purchase.

All payments are processed in Japanese Yen (JPY) unless otherwise stated. If prices are displayed in another currency for reference, the final charge may vary depending on your payment provider’s exchange rate and fees.

You agree to provide current, complete, and accurate billing, payment, and account information for all purchases. You authorize us and our payment processors to charge the payment method you provide for the total amount of your order, including applicable shipping charges and taxes.

If a pricing error, calculation error, exchange-rate display error, or other mistake occurs, we reserve the right to correct it and to cancel or revise the affected order, even after submission. If this happens, we will notify you and provide available options where appropriate.

SECTION 5 - PAYMENT METHODS

We currently accept credit card payments and any other payment methods shown at checkout.

For credit card payments, the actual billing date, payment due date, and other payment conditions are determined by your card issuer and your cardholder agreement. Please contact your card issuer directly for details.

SECTION 6 - SHIPPING, DELIVERY, AND RISK OF LOSS

Shipping times and delivery estimates are provided for reference only and are not guaranteed.

Product availability, procurement lead times, destination country, customs procedures, carrier operations, and shipping routes may affect dispatch and delivery timing. In general, products are usually shipped within one week, but this may vary depending on inventory and logistics conditions.

We are not liable for shipping or delivery delays caused by carriers, customs, manufacturers, distributors, force majeure events, or other circumstances beyond our reasonable control.

For international customers, you are the importer of record and are responsible for complying with the laws and regulations of the destination country. You are also responsible for any customs duties, import taxes, VAT, brokerage fees, clearance fees, or other charges imposed by authorities or carriers.

Risk of loss and title to products pass to you when the products are delivered to the shipping carrier, unless otherwise required by applicable law.

The transfer of risk under this Section does not limit any rights or remedies you may have under applicable law or under our Return & Refund Policy for defective, damaged, or non-conforming products.

SECTION 7 - RETURNS, CANCELLATIONS, DEFECTIVE PRODUCTS, AND WARRANTY SUPPORT

7.1 Customer-Initiated Cancellations, Returns, and Changes

Once an order has reached “preparing for shipment” status or later, we do not accept cancellations, returns, or changes due to customer convenience, except where expressly provided in our Return & Refund Policy or required by applicable law.

7.2 Initial Defects, Damage, Wrong Items, or Our Error

If a product has an initial defect, damage, wrong item, or material non-conformity attributable to us or the manufacturer, we may accept a return, replacement, refund, repair support, or another appropriate remedy under the following conditions:

you contact us by email as soon as possible and preferably within 3 days after delivery;
the product has not been used beyond what is reasonably necessary to inspect or confirm the issue;
the product, packaging, accessories, manuals, warranty card, and any included items are kept and returned in the condition reasonably requested by us;
the defect, damage, wrong item, or non-conformity is confirmed by us, the manufacturer, distributor, carrier, or an authorized service provider.

If the return or remedy is approved due to our error, an initial defect, damage, wrong item, or confirmed non-conformity, we will provide an appropriate remedy, which may include replacement, refund, repair support, or another reasonable solution at our discretion, subject to applicable law.

7.3 Non-Returnable or Refusable Cases

To the fullest extent permitted by law, we may refuse returns, refunds, exchanges, or warranty support in cases including, but not limited to:

products used beyond what is reasonably necessary to inspect or confirm the issue;
damage caused by customer misuse, mishandling, improper installation, modification, disassembly, repair attempt, improper storage, or failure to follow instructions;
damage caused after delivery to the customer;
requests made after the stated return or notice period, unless otherwise required by applicable law;
items returned without prior contact and approval;
missing accessories, manuals, warranty cards, packaging, tags, labels, or included items;
products purchased for resale, redistribution, or unlawful export;
products that cannot be returned for hygiene, safety, legal, or customs reasons;
special-order, made-to-order, discontinued, outlet, clearance, or final-sale products where returns are not accepted and this has been clearly indicated, except where required by applicable law.

7.4 Manufacturer’s Warranty

Where a product is covered by a manufacturer’s warranty, the warranty period, scope, conditions, availability, repair method, replacement method, and final warranty determination shall be determined solely by the manufacturer or its authorized service provider.

Upon the customer’s request, we may, at our discretion, assist the customer in contacting the manufacturer, distributor, or authorized service provider regarding warranty service. Any such assistance is provided as a courtesy only.

We do not independently determine or guarantee the scope, availability, duration, outcome, or processing time of any manufacturer’s warranty, repair, replacement, technical support, or parts supply.

For warranty claims handled by the manufacturer or its authorized service provider, we are not responsible for any inability to complete warranty service within the manufacturer’s warranty period due to international shipping times, customs delays, service-center processing times, parts availability, discontinued products, manufacturer policy changes, or other circumstances beyond our reasonable control.

To the fullest extent permitted by law, we are not responsible for any manufacturer’s refusal to provide warranty service, any change to warranty conditions, any discontinuation of parts or products, or any defect, specification error, design issue, manufacturing issue, safety issue, compatibility issue, or product information error attributable to the manufacturer, distributor, or other third party.

For the avoidance of doubt, manufacturer warranties are separate from, and in addition to, any mandatory statutory rights or remedies that the customer may have under applicable law, and nothing in this Section limits those rights or remedies.

7.5 Return Shipping Costs for International Returns

For returns from outside Japan that are not due to our error, a product defect, damage attributable to us, a wrong item, or non-conformity with the order or product description, the customer is responsible for all return shipping costs and related charges, including shipping fees, insurance, customs duties, import taxes, brokerage fees, clearance fees, and any other charges incurred in returning the product.

7.6 Refused Shipments and Unpaid Import Charges

If a shipment is refused by the customer, returned due to failed delivery caused by the customer, or returned because the customer fails or refuses to pay customs duties, import taxes, VAT, brokerage fees, clearance fees, or other import-related charges, any refund shall be limited to the purchase price actually paid for the product(s), less the actual costs and losses reasonably incurred by us in connection with the shipment and return, including:

outbound shipping charges;
return shipping charges;
customs charges;
handling fees;
storage fees;
payment processing fees to the extent non-refundable;
any reduction in value if the returned product cannot be resold as new.

Original shipping charges are non-refundable.

No deduction under this Section shall apply to the extent the return results from our error, from a defective product, from a wrong item, or from any non-conformity for which we are responsible under applicable law.

SECTION 8 - CUSTOMS, IMPORT RESTRICTIONS, AND INTERNATIONAL ORDERS

If you purchase products for delivery outside Japan, you are responsible for confirming that the products may lawfully be imported into your country.

We are not responsible for delays, seizure, refusal of import, additional costs, or losses caused by customs authorities, import restrictions, local regulations, or destination-country compliance requirements, except to the extent such responsibility cannot be excluded under applicable law.

We may be legally required to declare the accurate value and description of goods on customs documentation and cannot mark shipments as gifts or undervalue items.

SECTION 9 - INTELLECTUAL PROPERTY

All content available through the Services, including but not limited to text, graphics, images, logos, product descriptions, audio, video, website design, layout, and software, is owned by or licensed to us, our affiliates, licensors, or relevant rights holders, and is protected by copyright, trademark, and other applicable intellectual property laws.

You may use the Services only for personal, lawful, and non-commercial purposes. You may not reproduce, distribute, modify, republish, scrape, extract, download, create derivative works from, or otherwise exploit any content from the Services without our prior written consent, except as permitted under applicable law.

If a copyright or other rights dispute arises due to your misuse of content from this website, you are solely responsible for resolving it and for any resulting costs, damages, or liabilities.

SECTION 9A - BRAND NAMES, TRADEMARKS, AND GENUINE PRODUCTS

All brand names, product names, trademarks, service marks, logos, and images appearing on the Store belong to their respective owners.

We may use brand names, product names, and trademarks only to identify and describe the genuine products offered for sale on the Store. We sell genuine products sourced through lawful channels in Japan. However, manufacturer warranties, after-sales services, repair services, product support, product specifications, included accessories, and compatibility with destination-country standards may vary depending on the product, manufacturer, region, and sales channel.

Customers are responsible for confirming whether the product is suitable for use in their country or region, including voltage, plug type, safety standards, radio regulations, import restrictions, customs requirements, and manufacturer warranty availability.

Nothing in this Section limits any mandatory statutory rights or remedies that the customer may have under applicable law.

SECTION 10 - PRIVACY

Your submission of personal information through the Store is governed by our Privacy Policy and, where applicable, Shopify’s Privacy Policy.

By using the Services, you acknowledge that personal information may be collected, processed, and transferred as necessary to operate the Store, process transactions, fulfill orders, provide customer support, prevent fraud, and improve the Services.

Our total liability for any claim relating to the Services or any product purchased from us shall not exceed the amount you paid for the specific product giving rise to the claim, except where such limitation is not permitted by law.

Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, death, personal injury, or any liability that cannot be limited or excluded under applicable law.

Our store is powered by Shopify, which enables us to provide the Services to you. However, any sale or purchase made through the Store is made directly between you and us, not with Shopify.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale, product, delivery, return, defect, loss, injury, or dispute arising between you and us. Termination does not affect rights and obligations accrued prior to termination. For any dispute arising between you and us, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance, unless otherwise required by applicable law.

価格または商品情報に誤りがある場合
商品が入手不能である場合
配送制限がある場合
輸入または輸出制限がある場合
本利用規約に違反する場合

注文のキャンセルまたは重大な変更が必要となった場合、当店は、お客様が提供した連絡先情報を用いて通知するよう努めます。

注文送信前に、注文内容をよく確認してください。注文が「発送準備」以降のステータスに入った場合、お客様都合によるキャンセル、変更および返品は、返品・返金ポリシーに明示的に定める場合または適用法により要求される場合を除き、受け付けられません。

お客様は、当店を通じた購入が、適法な個人利用目的であり、再販売、再配布、または適用法に違反する輸出を目的とするものではないことを表明し保証します。

第4条 - 価格、通貨、税金および請求

すべての価格は商品ごとに表示されます。

別途明記されていない限り、商品価格には日本の消費税が含まれます。配送料、関税、輸入税、VAT、通関手数料、仲介手数料、その他配送先国、当局、配送業者または決済事業者により課される費用は、商品価格に含まれません。

配送料は、チェックアウト時または購入完了前に表示されます。

別途明記されていない限り、すべての支払いは日本円で処理されます。他の通貨で価格が参考表示される場合、最終請求額は、決済事業者の為替レートおよび手数料により変動する場合があります。

お客様は、すべての購入に関して、現在有効で完全かつ正確な請求情報、支払情報およびアカウント情報を提供することに同意します。お客様は、当店および決済処理業者が、提供された支払方法に対して、適用される配送料および税金を含む注文総額を請求することを承認します。

価格表示の誤り、計算誤り、為替表示の誤り、その他の誤りが発生した場合、当店は、注文送信後であっても、これを修正し、影響を受ける注文をキャンセルまたは変更する権利を留保します。その場合、当店はお客様に通知し、可能な場合には選択肢を提示します。

第5条 - 支払方法

当店は、クレジットカード決済およびチェックアウト時に表示されるその他の支払方法を受け付けています。

クレジットカード決済の場合、実際の請求日、支払期日、その他の支払条件は、お客様のカード発行会社およびカード会員規約により定められます。詳細はカード発行会社に直接お問い合わせください。

第6条 - 配送、引渡しおよび危険負担

配送期間および配送予定日は参考情報であり、保証されるものではありません。

商品の在庫状況、調達リードタイム、配送先国、通関手続、配送業者の運営状況および配送ルートにより、発送および配送時期は変動する場合があります。通常、商品は1週間以内に発送されますが、在庫および物流状況により変動する場合があります。

当店は、配送業者、税関、メーカー、販売代理店、不可抗力事由、その他当店の合理的な管理を超える事情により生じた発送または配送の遅延について責任を負いません。

海外のお客様は、輸入者として、配送先国の法令を遵守する責任を負います。また、関税、輸入税、VAT、仲介手数料、通関手数料、その他当局または配送業者により課される費用についてもお客様の負担となります。

適用法により別段の定めがある場合を除き、商品の滅失または損傷の危険および所有権は、商品が配送業者に引き渡された時点でお客様に移転します。

本条に基づく危険の移転は、欠陥、破損または契約不適合の商品に関して、お客様が適用法または当店の返品・返金ポリシーに基づき有する権利または救済を制限するものではありません。

第7条 - 返品、キャンセル、欠陥商品および保証サポート

7.1 お客様都合によるキャンセル、返品および変更

注文が「発送準備」以降のステータスに入った場合、お客様都合によるキャンセル、返品または変更は、返品・返金ポリシーに明示的に定める場合または適用法により要求される場合を除き、受け付けられません。

7.2 初期不良、破損、誤配送または当店の過失

商品に、当店またはメーカーに起因する初期不良、破損、誤配送または重大な契約不適合がある場合、当店は、以下の条件のもとで、返品、交換、返金、修理サポートまたはその他の適切な対応を行う場合があります。

商品到着後、できる限り速やかに、望ましくは3日以内にメールで当店に連絡すること
商品が、問題の確認に合理的に必要な範囲を超えて使用されていないこと
商品、パッケージ、付属品、説明書、保証書および同梱物が、当店が合理的に求める状態で保管・返送されること
欠陥、破損、誤配送または契約不適合が、当店、メーカー、販売代理店、配送業者または正規サービス提供者により確認されること

当店の過失、初期不良、破損、誤配送または確認された契約不適合により対応が承認された場合、当店は、適用法に従い、交換、返金、修理サポートまたはその他合理的な解決策を含む適切な対応を行います。

7.3 返品・返金等を受け付けられない場合

適用法により認められる最大限の範囲において、当店は、以下の場合を含め、返品、返金、交換または保証サポートを拒否する場合があります。

問題の確認に合理的に必要な範囲を超えて商品が使用された場合
お客様の誤用、取扱不良、不適切な設置、改造、分解、修理の試み、不適切な保管、または説明書不遵守により損傷が生じた場合
商品がお客様に引き渡された後に損傷した場合
適用法により別段の定めがある場合を除き、定められた返品または通知期間を過ぎて申請された場合
事前連絡および承認なく商品が返送された場合
付属品、説明書、保証書、パッケージ、タグ、ラベルまたは同梱物が不足している場合
再販売、再配布または違法な輸出を目的として購入された商品である場合
衛生、安全、法令または通関上の理由により返品できない商品である場合
特別注文品、受注生産品、廃番品、アウトレット品、クリアランス品または最終販売品であり、返品不可であることが明示されている場合。ただし、適用法により要求される場合を除きます。

7.4 メーカー保証

商品にメーカー保証が付帯する場合、その保証期間、範囲、条件、利用可否、修理方法、交換方法および最終的な保証判断は、メーカーまたは正規サービス提供者のみが決定します。

お客様からの要請に応じて、当店は、当店の裁量により、メーカー、販売代理店または正規サービス提供者への連絡を支援する場合があります。このような支援は便宜上提供されるものであり、保証の結果を約束するものではありません。

当店は、メーカー保証、修理、交換、技術サポートまたは部品供給の範囲、利用可否、期間、結果または処理時間を独自に判断または保証するものではありません。

メーカーまたは正規サービス提供者が取り扱う保証請求について、国際配送期間、通関遅延、サービスセンターの処理時間、部品在庫、廃番、メーカー方針の変更、その他当店の合理的な管理を超える事情により、メーカー保証期間内に保証サービスが完了できない場合であっても、当店は責任を負いません。

適用法により認められる最大限の範囲において、当店は、メーカーによる保証サービスの拒否、保証条件の変更、部品または商品の供給終了、またはメーカー、販売代理店その他の第三者に起因する欠陥、仕様誤り、設計上の問題、製造上の問題、安全上の問題、互換性の問題、商品情報の誤りについて責任を負いません。

念のため明記すると、メーカー保証は、お客様が適用法に基づき有する強行的な法定権利または救済とは別個に、これに追加して提供されるものです。本条のいかなる内容も、これらの権利または救済を制限するものではありません。

7.5 海外返品の返送料

日本国外からの返品であって、当店の過失、商品の欠陥、当店に起因する破損、誤配送、または注文内容・商品説明との不一致によるものではない場合、お客様は、返品にかかる送料、保険料、関税、輸入税、仲介手数料、通関手数料、その他返品に関連して発生するすべての費用を負担するものとします。

7.6 受取拒否および輸入関連費用の不払い

お客様が荷物の受取を拒否した場合、お客様に起因する配送失敗により商品が返送された場合、またはお客様が関税、輸入税、VAT、仲介手数料、通関手数料その他輸入関連費用の支払いを怠り、または拒否したことにより商品が返送された場合、返金額は、実際に支払われた商品代金から、当店が発送および返送に関連して合理的に負担した実費および損失を差し引いた金額を上限とします。これには以下が含まれます。

返送料
関税その他の税関関連費用
取扱手数料
保管料
返金不能な決済処理手数料
返品された商品を新品として再販売できない場合の価値減少分

元の配送料は返金されません。

ただし、返品が当店の過失、商品の欠陥、誤配送、または適用法上当店が責任を負う契約不適合に起因する場合、本条に基づく控除は適用されません。

第8条 - 税関、輸入制限および国際注文

日本国外への配送を目的として商品を購入する場合、お客様は、商品が配送先国に適法に輸入できることを確認する責任を負います。

適用法上排除できない責任を除き、当店は、税関当局、輸入制限、現地規制、配送先国の適合要件に起因する遅延、差押え、輸入拒否、追加費用または損失について責任を負いません。

当店は、通関書類において商品の正確な価額および説明を申告する法的義務を負う場合があり、商品を贈答品として記載したり、価額を過小申告したりすることはできません。

第9条 - 知的財産権

本サービスを通じて利用可能なすべてのコンテンツには、テキスト、グラフィック、画像、ロゴ、商品説明、音声、動画、ウェブサイトデザイン、レイアウトおよびソフトウェアを含みますが、これらに限られません。これらは、当店、当店の関連会社、ライセンサーまたは関係権利者により所有またはライセンスされており、著作権、商標権その他の適用される知的財産法により保護されています。

お客様は、本サービスを個人的、適法かつ非商業的な目的に限り利用できます。適用法により認められる場合を除き、当店の事前の書面による同意なく、本サービスのコンテンツを複製、配布、改変、再公開、スクレイピング、抽出、ダウンロード、二次的著作物の作成、その他利用することはできません。

お客様による本ウェブサイトのコンテンツの不正利用により著作権その他の権利に関する紛争が生じた場合、お客様は、その解決およびそれに伴う費用、損害または責任について単独で責任を負います。

第9条の2 - ブランド名、商標および真正品について

本ストアに表示されるブランド名、商品名、商標、サービスマーク、ロゴおよび画像は、それぞれの権利者に帰属します。

当店は、本ストアで販売する真正品を識別し説明する目的でのみ、ブランド名、商品名および商標を使用する場合があります。当該使用は、別途明示する場合を除き、当店が当該メーカー、ブランド権利者、販売代理店またはその他の権利者と提携、協賛、承認、認定、公式販売店関係その他の公式な関係を有することを意味するものではありません。

各商品ページで別途明示する場合を除き、当店はメーカーまたはブランド権利者の正規代理店、公式販売店、認定販売店、代理人または代表者ではありません。

当店は、日本国内の適法な流通経路を通じて仕入れた真正品を販売しています。ただし、メーカー保証、アフターサービス、修理サービス、製品サポート、商品仕様、付属品、および配送先国の規格への適合性は、商品、メーカー、地域および販売経路により異なる場合があります。

お客様は、電圧、プラグ形状、安全規格、電波規制、輸入制限、通関要件、メーカー保証の利用可否を含め、商品がお客様の国または地域での使用に適しているかを確認する責任を負います。

本条のいかなる内容も、お客様が適用法に基づき有する強行的な法定権利または救済を制限するものではありません。

第10条 - プライバシー

お客様による本ストアを通じた個人情報の提供は、当店のプライバシーポリシーおよび該当する場合は Shopify のプライバシーポリシーに従います。

本サービスを利用することにより、お客様は、本ストアの運営、取引処理、注文履行、カスタマーサポート、不正防止およびサービス改善のために必要な範囲で、個人情報が収集、処理および移転される場合があることを了承します。

第11条 - Cookie およびサイト技術

当店は、ウェブサイトの運営、お客様の設定の記憶、ショッピングカートの維持、サイト利用状況の分析、およびサービス改善のために、Cookie、ピクセルおよび類似技術を使用する場合があります。

ブラウザ設定で Cookie を無効にした場合、チェックアウトやカート機能を含む一部のウェブサイト機能が正常に動作しない場合があります。

第13条 - フィードバック、レビューおよびユーザー投稿

お客様がレビュー、コメント、提案、アイデアその他のコンテンツを当店に送信した場合、お客様は、当店に対し、マーケティングおよびサービス改善を含む事業目的のために当該コンテンツを使用、複製、編集、公開、表示、翻訳および配布する、非独占的、全世界的、無償、永続的なライセンスを付与するものとします。

お客様は、以下を表明するものとします。

当該コンテンツを投稿する権利を有すること
当該コンテンツが正確であり、誤解を招かないこと
当該コンテンツが第三者の権利を侵害せず、法令に違反しないこと

当店は、違法、権利侵害、不快、虐待的、誤解を招く、または不適切であると当店が判断する投稿を監視、編集、拒否または削除する権利を有しますが、その義務を負うものではありません。

第14条 - 禁止行為

お客様は、本サービスを適法な目的のためにのみ利用できます。お客様は、本サービスを以下の目的で利用してはなりません。

適用法令に違反すること
詐欺行為または他人へのなりすましを行うこと
知的財産権その他の権利を侵害すること
マルウェア、ウイルスその他有害なコードを送信すること
ウェブサイトの運営またはセキュリティを妨害すること
無断でウェブサイトからデータをスクレイピング、収集、マイニングまたは抽出すること
当店の管理を負荷、妨害または回避する方法で、ボット、自動化ツールまたはAIエージェントを使用して本サービスにアクセスまたは操作すること
虚偽、誤解を招く、または虐待的なコンテンツを投稿すること

当店は、本利用規約に違反した場合、本サービスへのアクセスを停止または終了する権利を留保します。

第15条 - エージェントおよび自動アクセス

ソフトウェアエージェント、ボット、クローラー、スクレイパーその他の自動システムは、当店の指示、技術的管理または適用法に違反して、本サービスにアクセス、利用または操作してはなりません。

当店は、いつでも自動アクセスに対する技術的またはポリシー上の制限を実施する場合があります。許可された自動アクセスは、自動であることを正確に識別しなければならず、自動であることを隠したり、人間の行動を欺瞞的に模倣したり、セキュリティおよびアクセス制御措置を回避したりしてはなりません。

第16条 - 保証の免責

適用法により認められる最大限の範囲において、本サービス、ならびに本サービスを通じて提供されるすべての商品およびコンテンツは、「現状有姿」および「提供可能な範囲」で提供されます。

当店は、以下を保証しません。

本サービスが中断なく、安全に、またはエラーなく提供されること
ウェブサイトのコンテンツが常に正確、完全または最新であること
メーカー提供の商品情報が常に正確、完全、最新または誤りのないものであること
商品がお客様の主観的な期待を常に満たすこと
欠陥が常に直ちに修正されること

本利用規約のいかなる内容も、適用法上排除または制限できない保証、消費者保証、法定保証、撤回権、クーリングオフ権、その他の権利または救済を排除、制限または変更するものではありません。

第17条 - 責任の制限

適用法により認められる最大限の範囲において、当店、当店の関連会社、役員、取締役、従業員、代理人、サービス提供者、ライセンサー、ならびに Shopify およびその関連会社は、本サービスの利用または当店からの商品購入に起因または関連して生じる、間接損害、付随的損害、特別損害、結果損害、懲罰的損害、逸失利益、売上損失、節約利益の喪失、データ喪失、事業中断、代替費用、配送遅延、通関遅延、メーカー遅延、または商品の使用不能による損失について責任を負いません。

本サービスまたは当店から購入された商品に関する請求について、当店の責任総額は、当該請求の原因となった特定の商品についてお客様が支払った金額を超えないものとします。ただし、当該制限が法律により認められない場合を除きます。

本利用規約のいかなる内容も、詐欺、故意の違法行為、重大な過失、死亡、人身傷害、または法律上制限もしくは排除できない責任を制限するものではありません。

第18条 - 補償

お客様は、以下に起因または関連して生じる請求、損害、損失、責任、費用および経費について、合理的な弁護士費用を含め、当店、Shopify、当店の関連会社、役員、取締役、従業員、代理人、請負業者、ライセンサーおよびサービス提供者を補償し、防御し、免責することに同意します。

第19条 - Shopify との関係

当店のストアは Shopify により提供されており、これにより当店はお客様に本サービスを提供できます。ただし、本ストアを通じて行われる売買は、お客様と当店との間で直接行われるものであり、Shopify との間で行われるものではありません。

本サービスを利用することにより、お客様は、Shopify が、お客様と当店との間で生じる販売、商品、配送、返品、欠陥、損失、傷害または紛争のいかなる側面についても責任を負わないことを了承し、同意するものとします。適用法により認められる最大限の範囲において、お客様は、当店との取引に起因する請求について、Shopify およびその関連会社を免責するものとします。

第20条 - 誤記、不正確な情報および記載漏れ

本ウェブサイト上の情報には、商品説明、仕様、互換性、価格、在庫状況、プロモーション、配送料または配送期間に関する誤記、不正確な情報または記載漏れが含まれる場合があります。

当店は、注文送信後を含め、いつでも予告なく、当該誤りを修正し、情報を変更または更新し、または情報が不正確である場合に注文をキャンセルする権利を留保します。

注文後に重大な誤りが判明した場合、当店は、お客様に連絡し、注文を継続するか、変更するか、またはキャンセルするかを確認する場合があります。商品がすでに配送されており、注文内容または商品説明と重大に異なる場合、当店は返品・返金ポリシーおよび適用法に従って対応します。

第21条 - 終了

当店は、お客様が本利用規約または適用法に違反したと判断した場合、事前通知なく、いつでも本サービスへのアクセスを停止または終了することができます。

終了は、終了前に発生した権利および義務に影響を与えません。その性質上、終了後も存続すべき条項は、知的財産、免責、責任制限、補償、準拠法および紛争解決に関する条項を含め、終了後も存続します。

第22条 - 分離可能性

本利用規約のいずれかの条項が違法、無効または執行不能と判断された場合、当該条項は法律上認められる最大限の範囲で執行され、残りの条項は引き続き完全な効力を有します。

第23条 - 権利不放棄および完全合意

当店が本利用規約のいずれかの条項を行使しなかった場合であっても、当該条項の権利放棄とはみなされません。

本利用規約、返品・返金ポリシー、プライバシーポリシー、および本ウェブサイト上に掲載されるその他のポリシーは、本サービスの利用に関するお客様と当店との完全な合意を構成し、同一事項に関する従前のすべての連絡または合意に優先します。

第24条 - 譲渡

お客様は、当店の事前の書面による同意なく、本利用規約に基づく権利または義務を譲渡、移転または委任することはできません。

当店は、法律により認められる範囲で、お客様への通知なく、本利用規約に基づく権利および義務を譲渡または移転することができます。

第25条 - 準拠法および管轄

本利用規約、ならびに本サービスまたは本ストアを通じた購入に起因または関連する紛争は、抵触法の原則にかかわらず、日本法に準拠し、解釈されます。

お客様と当店との間で生じる紛争については、適用法により別段の定めがある場合を除き、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

第26条 - 言語

本利用規約は、英語および日本語で提供される場合があります。正文は英語版です。日本語版は参考および便宜のために提供されるものです。英語版と日本語訳との間に不一致または矛盾がある場合、適用法により禁止される場合を除き、英語版が優先されます。

第27条 - 本利用規約の変更

当店は、本ページに更新版を掲載することにより、いつでも本利用規約を変更する権利を留保します。

別途明記されていない限り、変更は掲載時点で効力を生じます。変更掲載後もお客様が本サービスの利用を継続する場合、お客様は改訂後の利用規約に同意したものとみなされます。
